Privacy & Cookie Policy

Last Updated: October 12, 2023
In this policy, we describe our privacy practices: what data we collect from our visitors and customers, how we collect it, what we do with it, how we protect it, and your rights regarding your personal data.
By using our website, you confirm that you have read this privacy policy.

1. IMPORTANT

With this privacy policy, we aim to clearly describe when, why, and how we collect and use your personal data and what your legal rights are concerning this information. This privacy policy is not intended to replace any rights you may have under applicable data privacy laws.

Before making purchases on our website, please read this privacy policy and ensure you fully understand our practices regarding your personal data. If you have read and understood this privacy policy but do not agree with our practices, you should immediately leave or close this website. If you have any questions regarding this privacy policy, you can contact us at info@colortone.nl.

2. What Data We Collect

We collect two types of data about our visitors and customers:

  • Non-identifiable information: This refers to data that cannot identify a specific visitor or customer. Non-personal data mainly includes technical and aggregated usage information, such as browsing activity, session heatmaps, click-stream data, device information, operating systems, browser types, screen resolutions, language and keyboard settings, referring and exit pages, and date and time stamps. This information helps us improve our website and services.
  • Personally identifiable information: This includes any data that identifies an individual or can reasonably be linked to an individual. Personal data we collect may include contact details (email address, phone number), billing details (name, physical billing address, payment method, transaction details), browser or session data (IP address, geographic location, device ID), linked account details (email or username from external accounts like PayPal or Facebook), and any other personal data provided by customers during purchases. Non-personal data linked to personal data is treated as personal data as long as the link exists.

3. How We Collect This Information

We collect information primarily through two methods:

  • Automatically: We collect data when you use our website. This includes information collected through cookies and other tracking technologies, such as your browsing activity and session details.
  • Provided by you: We collect personal data when you voluntarily provide it to us, such as when you register for a COLORTONE account, log in via third-party platforms (e.g., Facebook or Google), or contact us directly through communication channels like email.

4. Why We Collect This Information

We collect non-personal and personal data for the following purposes:

  • To provide and deliver our products or services.
  • To further develop, customize, and improve our website and products based on shared or individual preferences, experiences, and feedback from visitors and customers.
  • To offer customer support and assistance.
  • To communicate with visitors and customers regarding general or personalized service-related information and promotional messages.
  • To facilitate contests and promotions, verify participants’ eligibility, monitor results, contact winners, and distribute prizes or other benefits.
  • To generate aggregated statistical data and other aggregated or inferred non-personal information that we may use to provide and improve our services.
  • To enhance data security and fraud prevention.
  • To comply with applicable laws and regulations.

We will only use your personal data for the purposes outlined in section 4 if we are confident that:

  • The use of your personal data is necessary to provide you with support or technical assistance.
  • The use of your personal data is required to comply with a legal obligation that applies to us.
  • The use of your personal data is necessary for our legitimate business interests (e.g., maintaining and improving our webshop or blog by analyzing usage trends, addressing technical issues, or evaluating the effectiveness of COLORTONE’s marketing efforts), provided that it is always conducted in a way that respects your privacy rights.

Purchasing from our webshop is not permitted for individuals under 18 years of age. If you are under 18, do not provide any personal data through our website. We never knowingly collect personal data from individuals under 18. Parents or guardians should always supervise their children’s online activities.

5. Where We Store Your Data

Personal data of visitors and customers may be stored, processed, and maintained by COLORTONE as necessary for proper service delivery and/or as required by law (as outlined below).

Upon request, COLORTONE will inform you whether we hold any personal data about you. You may access, correct, or request deletion of your personal data. We will respond to your request within the legally required timeframe or within a reasonable period.

Note: Final deletion of your account means that all your information will be erased from COLORTONE’s databases. Once this process is complete, your account can no longer be used, and all associated data will be permanently deleted. COLORTONE will no longer be able to retrieve or restore your data or account. If you contact COLORTONE in the future, the system will not recognize your account, and we will not be able to locate it.

6. Sharing Personal Data with Third Parties

COLORTONE may share your personal data with third parties (or otherwise grant them access to your personal data) only in the following ways and circumstances:

Third-Party Services:

COLORTONE partners with several selected service providers whose services and solutions complement, support, and enhance our website operations. These include hosting and server co-location services, communication services, billing and payment processing services, domain name registration, analytics, e-mail distribution and monitoring services, session recording services, remote access services, performance measurement, data optimization, marketing services, content providers, and our legal and financial advisors (collectively “Third-Party Services”).

The providers of these Third-Party Services may receive or otherwise have access to personal data of our visitors and customers, depending on their particular roles and purposes in facilitating and enhancing our website operations, and may only use such data for those purposes.

Note: While our website may contain links to other websites or services, we are not responsible for the privacy practices of such websites or services. We encourage you to be aware when you leave our website and to read the privacy statements of each website and service you visit before providing any personal data. This privacy policy does not apply to external websites and services linked to from our website.

Judicial Authorities, Legal Requests, and Obligations:

Where permitted by local data protection laws, COLORTONE may disclose personal data to others, with or without notice to you, in response to a legal request, such as a subpoena, court proceeding, search warrant, or court order, or in compliance with applicable laws if we believe in good faith that we are legally required to do so.

Protection of Rights and Safety:

COLORTONE may share personal data with third parties, with or without notice to you, if we believe in good faith that doing so will help protect the rights, property, or personal safety of COLORTONE, one or more of our customers, or any member of the public.

Social Media Features and Frames:

Our website includes certain social media features and widgets, such as the “Facebook Like” button, “Share this” button, and other interactive mini-programs (“Social Media Features”). These Social Media Features may collect information such as your IP address or the page you are visiting on our website and may set a cookie to enable proper functioning. Social Media Features are either hosted by a third party or directly on our website. Your interactions with these Social Media Features are governed by the privacy policy of the third-party providers, not by our policy.

Additionally, personal data may be shared directly with third parties through frames on our website that deliver content from or to third parties or external services while preserving the appearance of our website (“Frames”). Please be aware that if you interact with or share personal data through such frames, you are providing that data to the relevant third parties and not to us, and that such interactions and data handling are governed by the third-party policies, not ours.

7. Use of Cookies and Other Tracking Technologies

In collaboration with marketing, analytics, and technology partners, COLORTONE uses certain monitoring and tracking technologies, such as cookies, web beacons, pixels, tags, and scripts. These technologies help us maintain and improve our website and provide a better user experience for our visitors and customers. They enable us to, among other things, track user preferences and authenticated sessions, secure our website, identify technical issues, monitor usage trends and the effectiveness of campaigns, and generally monitor and improve the overall performance of our webshop.

Cookies:

Certain technologies function only by downloading and storing a small data file (“cookie”) on your device. By default, we use several persistent cookies for session and user authentication, security, tracking user preferences (such as language and other settings), ensuring connection stability (e.g., during media uploads), evaluating the performance of our webshop and marketing campaigns, and in general delivering and improving our services.

If you want to remove or block cookies, please refer to your web browser’s Help and Support section for instructions on locating the files or directories that store cookies. Information on deleting or controlling cookies is also available at www.AboutCookies.org (note that this website is not provided by COLORTONE, and we cannot guarantee its accuracy, completeness, or availability).

Note: If you delete or disable our cookies or other tracking technologies, you may not be able to access certain parts or features of our website, and your user experience may be affected.

Flash Cookies and HTML5:

We and certain Third-Party Service providers may use certain tracking technologies known as “Flash Cookies” and “HTML5” primarily for advertising purposes. Different browsers may offer their own management tools for removing or blocking such technologies. For additional information on managing Flash Cookies, see this link (note that this website is not provided by COLORTONE, and we cannot guarantee its accuracy, completeness, or availability).

“Do Not Track” Settings:

We do not change our practices in response to a “Do Not Track” setting in the HTTP header of a web browser or mobile application.

8. Communications from COLORTONE

1. Promotional Messages:

We may use your personal data to send you promotional messages and information via email, directly from COLORTONE.

If you do not wish to receive such promotional messages, you can inform us at any time or follow the instructions to "Unsubscribe" in the promotional messages you receive.

We take measures to limit the frequency of the promotional messages we send and strive to ensure that the content is relevant and interesting to you, based on your data.

9. Your Rights Regarding Your Personal Data

It is essential that you have control over your personal data. Therefore, COLORTONE takes steps to ensure that you can view, update, correct, or delete your personal data, request a copy, and limit its use.

Before providing the requested personal data, we may ask you for additional information to verify your identity and maintain security.

You have the right to file a complaint with your data protection authority (though we encourage you to contact us first).

If you are a visitor or customer of COLORTONE and wish to request a copy of your personal data stored by us, you can send your request by mail to COLORTONE, Boslaan 43, 2132 RJ Hoofddorp, or email us at info@colortone.nl. We will make reasonable efforts to respond to your request promptly (unless additional information is required), subject to legal and other permissible considerations.

Note: Permanently deleting your COLORTONE account means that all your information will be erased from COLORTONE’s databases. Once the process is complete, you will no longer be able to use your account, and all associated data will be permanently deleted. COLORTONE will not be able to retrieve your account or data. If you contact COLORTONE in the future, the system will not recognize your deleted account.

10. Questions and Complaints

We take all privacy-related complaints seriously and will do our utmost to resolve your complaint as quickly as possible. We aim to respond within 30 days.

We expect our procedures to be sufficient to handle your complaint fairly and promptly. However, if you are not satisfied with the outcome, you may also file a complaint with your national data protection authority.

You can always submit a complaint to your data protection authority, but we ask that you contact us first so we can try to resolve your issue to your satisfaction.

11. Data Retention

We may retain your personal data for as long as your COLORTONE account is active or as described in this privacy policy.

If you wish to request the deletion of your personal data, please contact us via info@colortone.nl. Upon receiving your request, we will take reasonable steps to delete your information unless we are required by law to retain it.

Note: Permanent deletion of your COLORTONE account means that all your information will be erased from our databases. After this process, you will no longer be able to use your account, and we will not be able to retrieve your data. If you contact us in the future, our system will not recognize the deleted account.

12. Security

COLORTONE uses Shopify as its web hosting provider. Shopify has implemented security measures to protect the personal data you share with us, including physical, electronic, and procedural safeguards. Shopify provides secure HTTPS access to most areas of the website, ensures that sensitive payment data (such as credit card numbers) is transmitted securely using industry-standard SSL/TLS encryption, and regularly undergoes PCI DSS (Payment Card Industry Data Security Standards) certification. Additionally, their systems are routinely monitored for vulnerabilities and attacks, and they continually seek new methods and third-party services to enhance the security of the website and protect the privacy of visitors and customers.

Despite all of COLORTONE’s efforts and measures, we cannot guarantee absolute protection of your personal data or any other user content uploaded, published, or shared with COLORTONE.

Therefore, we recommend that you set strong passwords for your COLORTONE account and never share sensitive information that could cause severe or irreversible harm if disclosed.

Note: Although our website uses Shopify services, we are not responsible for Shopify’s privacy practices.

If you have any questions about the security of our services, feel free to contact us via info@colortone.nl.

13. Updates and Interpretation

We may update this privacy policy when required by law or to reflect changes in how we collect, store, and use information. If we make changes that we consider to be “material” (determined in good faith by us), we will notify you before the changes take effect, using one of the notification methods available. We recommend that you periodically revisit this page to stay informed about our privacy practices. Unless otherwise stated, our most recent privacy policy applies to all information we hold about you concerning our website.

The headings, captions, or article titles in this document are provided for informational purposes only and do not define, limit, or describe any section or provision. They do not bind us in any way.
